Questions regarding key issues?

i have a 98 ML320,once a day the key won't even start the car and when that happens i'm unable to pull it out,i have to keep trying for about 3 to 5 mns and then magic it starts like nothing never happened.the first key that came with the car needs programming,i'm using the last set,need clues,thanks.
